Terms of Service

These terms govern your use of TheRox. Please read the Health & Fitness Disclaimer in Section 4 carefully.

1. Acceptance

By creating an account on or using the TheRoxmobile application or website (together, the "Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service. Our Privacy Policy is incorporated by reference.

2. Eligibility

You must be at least 18 years of age to use TheRox or to join our waitlist. The Service is intended solely for adults; there are no exceptions and no parental-consent pathway. By using the Service you represent that you meet this requirement.

3. Your Account

You are responsible for keeping your credentials confidential and for all activity under your account. Provide accurate information and keep it current. Notify us immediately of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

4. Health & Fitness Disclaimer

Please read this section carefully. It contains important information about your health and safety.

TheRox provides general fitness information and exercise form feedback for educational purposes only. TheRox is not a medical device and does not diagnose, treat, cure, or prevent any medical condition.

The AI Form Tracker provides approximate guidance based on pose estimation and is not a substitute for professional coaching, physiotherapy, or medical advice. Form scores and rep counts are estimates and may be inaccurate. It does not detect injuries or dangerous movements.

Exercise carries inherent risks, including injury. Consult a qualified medical professional before beginning any fitness program, especially if you have a pre-existing condition, injury, or disability. You are solely responsible for your health and safety while using the Service. Workout videos accessible through TheRox are third-party content we do not verify, endorse, or guarantee.

5. Subscriptions & Payments

5.1 Free and Pro

TheRox offers a free tier and a Pro subscription at $4.99 per month or $39.99per year. We may change pricing with 30 days' advance notice to existing subscribers.

5.2 Auto-Renewal

Pro subscriptions renew automatically at the end of each billing period at the then-current price unless you cancel before the renewal date. Charges are processed through Stripe.

5.3 Cancellation

Cancel anytime in your account settings. Pro features remain active until the end of the current period, after which the account reverts to the free tier. We do not provide partial refunds for unused time.

5.4 Refunds

You may request a refund within 30 days of your initial purchase by emailing [email protected]. Renewal charges are not refundable if not canceled before renewal.

6. Challenges (Gym Rat)

6.1 Participation

By joining a challenge with an invite code, you consent to sharing limited data with co-members as described in our Privacy Policy: your display name, points, and per-workout log details (folder name, optional note, duration, date).

6.2 Conduct

Logging is honor-based. You agree not to:

  • Log fraudulent or fabricated workouts
  • Use offensive or inappropriate language in notes
  • Share join codes to harass or harm others
  • Attempt to access challenges you are not a member of

We may remove users from challenges or suspend accounts for violations.

6.3 Leaving

Leave any challenge at any time; your data is removed from that leaderboard. If you delete your account, your data is anonymized across all challenges.

7. Content & Intellectual Property

7.1 Your Content

You retain ownership of content you create (folder names, notes, plans). You grant us a limited license to store, display, and process it solely to provide the Service to you.

7.2 Third-Party Content

TheRoxlets you organize videos hosted on third-party platforms (YouTube, Instagram, TikTok). We do not host, download, or modify these videos; they are subject to their platforms' terms. We are not responsible for their content, accuracy, or availability.

7.3 Our Property

The TheRox name, logo, design, and software are our intellectual property. You may not copy, modify, distribute, or reverse-engineer any part of the Service without our prior written consent.

8. Disclaimers & Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ANIRBAN DAS AND VINÍCIUS FERREIRA BANDEIRA DO NASCIMENTO WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR HEALTH OUTCOMES, ARISING FROM YOUR USE OF (OR INABILITY TO USE) THE SERVICE. OUR TOTAL LIABILITY WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

9. Indemnification

You agree to indemnify and hold TheRox harmless from claims, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of third-party rights.

10. Termination

You may delete your account at any time. We may suspend or terminate your account for violations or conduct we determine is harmful. Upon termination, your right to use the Service ceases. Sections 4, 8, 9, and 11 survive termination.

11. Governing Law

These Terms are governed by the laws of Poland, without regard to conflict-of-laws principles. Disputes will be resolved in the competent courts of Poland. If any provision is unenforceable, the remainder stays in effect.

12. Changes

We may update these Terms. We will post changes and update the effective date; material changes will be notified in-app. Continued use constitutes acceptance.
